Matrimonial Dispute Widens Into Parallel Legal Proceedings Across Delhi and Uttar Pradesh
A June 2025 complaint by Ayush Gupta preceded Nikita Jaiswal’s September 2025 Kanpur FIR; subsequent proceedings have brought documentary evidence, competing allegations and judicial scrutiny into the public record.
New Delhi, 17 September 2026 (GNI) : June 2026 reports on proceedings against Ayush Gupta and members of his family did not mention that his own criminal complaint had already been pending before a Delhi court since June 2025. That complaint has now resulted in summons against Nikita Jaiswal and her parents, following a court-directed inquiry that examined official attendance records, CCTV footage, medical documentation and other material.
The court records show that by the time Nikita Jaiswal’s FIR was lodged in Kanpur on 21 September 2025, Ayush Gupta had already made two complaints to Delhi Police, on 29 December 2024 and 25 April 2025, and had filed his criminal complaint before the Dwarka Court on 30 June 2025, on which notice had been issued.
The Delhi complaint names Nikita Jaiswal, Narender Jaiswal, Kusumlata Jaiswal, Nitish Jaiswal and Suchita Jaiswal as proposed accused and cites Sections 61, 79, 115, 116, 303, 305, 316 and 351 of the Bharatiya Nyaya Sanhita.
The sections cited in the complaint are distinct from the provisions under which the court subsequently issued summons at the cognizance stage.
What the Delhi Record Shows
The September 2026 order records allegations in Ayush Gupta’s complaint concerning physical violence, threats of criminal implication and the alleged removal of jewellery, cash and documents from his parents’ residence.
Because the proposed accused persons were residing outside Delhi, the court directed an inquiry under Section 225 of the BNSS. The resulting inquiry examined CCTV footage, official attendance records, medical documentation and the statement of a domestic worker. The pharmacy bill produced in relation to an alleged hot-water incident of 4 April 2025 was independently verified during the inquiry.
One of the key issues examined was an allegation made by Nikita Jaiswal in relation to 24 April 2025. Her medico-legal report alleged that she had been assaulted by her husband and his family at about 11 a.m. that day. The attendance record obtained from her workplace, however, showed her presence at work from 10:24 a.m. to 6:26 p.m. The court observed that, at the prima-facie stage, the discrepancy lent credence to the complainant’s version and undermined the counter-allegation, while noting that the final evidentiary value would be determined at trial.
The inquiry also examined CCTV footage from 25 April 2025 showing Nikita Jaiswal leaving the residence carrying four to five bags, with no other person seen entering or leaving during the relevant period. A domestic worker told the inquiry that Nikita Jaiswal had entered the bedroom of Ayush Gupta’s mother, prevented her from entering, packed articles into a bag and then left hurriedly. The court also considered an email attributed to Nikita Jaiswal concerning family jewellery.
The inquiry also examined CCTV footage from 27 December 2024 which, according to the court record, purportedly showed Nikita Jaiswal’s parents threatening the complainant and his family with implication in criminal cases.
Nikita Jaiswal denied the allegations during the inquiry and stated that they were false and baseless. The court treated the competing versions and their evidentiary value as matters for trial.
On 5 September 2026, after considering the complaint, pre-summoning evidence, documentary material and the Section 225 BNSS investigation report, the Delhi court recorded prima-facie material to take cognizance and proceed against specified proposed accused persons. The court summoned Nikita Jaiswal under Sections 115, 303(2) and 351(2) of the BNS, and Narender Jaiswal and Kusumlata Jaiswal under Section 351(2). Nitish Jaiswal and Suchita Jaiswal, although named in the complaint, were not summoned at this stage. The matter is next listed for 16 November 2026.
The Sequence of Events
Ayush Gupta made a police complaint on 29 December 2024, followed by another complaint on 25 April 2025 relating to the alleged loss of jewellery and ₹3 lakh in cash. Nikita Jaiswal’s Kanpur FIR was lodged on 21 September 2025, followed by a complaint under the Domestic Violence Act in Kanpur on 31 October 2025.
This chronology places Ayush Gupta’s Delhi complaint nearly three months ahead of the Kanpur FIR and establishes that the Delhi complaint had already been pending for nearly a year by the time the Kanpur proceedings received significant media attention in June 2026.
June 2026 reports on the Kanpur proceedings, including reports quoting Nikita Jaiswal’s counsel, did not refer to the earlier Dwarka complaint filed by Ayush Gupta in June 2025, which had already been pending for nearly a year.
The Kanpur Proceedings
The Kanpur case subsequently followed a separate procedural track. On Nikita Jaiswal’s objection to a chargesheet that named only Ayush Gupta, a Kanpur magistrate on 12 June 2026 summoned Ayush Gupta, members of his family and another person identified in media reports as a relative. According to a report published by Amar Ujala on 21 June 2026, the court also recommended disciplinary action in relation to the reassignment and handling of the investigation.
Ayush Gupta and the other applicants challenged the 12 June 2026 summoning order, the related chargesheets and the proceedings before the Allahabad High Court. In its order dated 3 August 2026, the High Court referred the matrimonial dispute to mediation and directed that the operation of the 12 June summoning order remain stayed until the next listing, subject to the conditions recorded in the order. The matter was directed to be listed in the week commencing 14 December 2026 along with the mediation report.
On 11 September 2026, proceedings under the Protection of Women from Domestic Violence Act were also referred to mediation. The High Court directed that no coercive measures be taken against the applicants until the next date of listing, subject to the conditions recorded in the order. The matter is listed for 11 December 2026 along with the mediation report.

Suchita Jaiswal, who is named as a proposed accused in Ayush Gupta’s Delhi complaint, is the elder sister of Nikita Jaiswal. Her husband, Arun Vikas Porwal, was reported in November 2024 as having been arrested in connection with a Kanpur POCSO case involving a minor NEET aspirant.
The New Indian Express reported on 10 November 2024 that Vikas Porwal, described as a chemistry instructor, was among two teachers arrested in the case and booked under provisions relating to rape, criminal intimidation, wrongful confinement and the POCSO Act.
The POCSO proceedings are separate from the matrimonial dispute, and the reference does not establish any involvement by Suchita Jaiswal in that case.

The Delhi matter is next listed for further proceedings on 16 November 2026 following the 5 September 2026 cognizance and summoning order. The Kanpur proceedings challenged before the Allahabad High Court have been referred to mediation, with the matter listed in the week commencing 14 December 2026. The separate Domestic Violence Act proceedings have also been referred to mediation, with the matter listed for 11 December 2026, subject to the Court’s interim directions.
The chronology now on record shows that Ayush Gupta’s Delhi complaint was already before a court months before the subsequent Kanpur FIR, while the Delhi proceeding has since progressed to the cognizance and summoning stage following a court-directed inquiry into documentary and other evidence.
